Draft Proposed Guide to Lot Creation in Prime Agricultural Areas
During the consultation on the revised Provincial Policy Statement (PPS) in 2004, many municipalities and stakeholders identified a need for additional support materials to assist land use planners and municipalities to implement the policies of the Provincial Policy Statement. The Ministry of Agriculture, Food and Rural Affairs has prepared a draft proposed Guide to Lot Creation in Prime Agricultural Areas intended to assist municipalities to implement the lot creation policies of the Provincial Policy Statement for prime agricultural areas in their local official plans and comprehensive zoning by-laws. The Ministry is consulting on the content of this document prior to finalizing the Guide. The Provincial Policy Statement (PPS) is issued under the authority of Section 3 of the Planning Act and came into effect on March 1, 2005. It was approved by the Lieutenant Governor in Council, Order in Council No. 140/2005. In respect of the exercise of any authority that affects a planning matter, Section 3 of the Planning Act requires that decisions affecting planning matters shall be consistent with policy statements issued under the Act. The Provincial Policy Statement sets out provincial land use policies, including policies for protecting prime agricultural areas for long-term use for agriculture. To support the protection of prime agricultural areas, the PPS discourages the creation of lots in these areas. A review of the lot creation policies for prime agricultural areas as outlined within the Provincial Policy Statement is not contemplated by the Province at this time.
